Terms of Service (International / ShrimpSend)

These Terms of Service (“Terms”) govern your use of ShrimpSend clients (mobile, desktop, HarmonyOS, etc.) and the Web app when you connect to our international service cluster (for example https://api.shrimpsend.com / wss://ws.shrimpsend.com).

1. Acceptance & changes

By creating an account, logging in, or using the service, you agree to these Terms. We may update the Terms; continued use after notice means acceptance unless law requires separate consent.

2. The service

ShrimpSend provides cross-device messaging and file relay, including account registration/login, multi-device management, realtime sync, BYO S3-compatible storage (presigned uploads/downloads), LAN HTTP and WebRTC-assisted transfers (signaling via our infrastructure), discovery features, and QR login, subject to the build you install.

We strive for reliability but do not guarantee uninterrupted or error-free operation.

3. Account security

You are responsible for safeguarding credentials and for activity under your account. Notify us of unauthorized use.

4. Acceptable use

You will not use the service to violate law, infringe rights, distribute malware, attack our systems, scrape in an abusive way, or circumvent security. We may suspend or terminate accounts for violations.

5. Intellectual property

We and our licensors own the software, branding, and documentation (except your content and third-party materials). No reverse engineering except where prohibited by law.

6. Membership, subscriptions & hosted quota (international only)

This section applies only to the international deployment.

6.1 Tiers, device limits & hosted upload quotas

Hosted object storage uploads (where enabled) are metered per UTC calendar month. Non‑hosted / BYO storage paths follow their own rules.

6.2 Hosted object retention and automatic deletion

Hosted object storage is a temporary relay for cross-device file transfer and is not a long-term cloud drive or backup service. Unless otherwise stated on the product page, hosted objects may be retained for up to 30 days after upload and may be deleted automatically after that period; deletion may complete within a processing window after expiration.

We may also delete or restrict access to hosted objects earlier if you delete the related message or file, your account is terminated, the content violates these Terms, security or abuse risks are detected, or deletion is required by law. Please download and back up files you need to keep long term.

6.3 Pricing & auto‑renewal

Paid tiers are sold as subscriptions (monthly and/or yearly) through Apple App Store, Google Play, and/or Stripe (web checkout). Prices, taxes, and currency are shown at purchase in the respective store or checkout page and may change for new purchases as permitted by the store.

Subscriptions auto‑renew until you cancel in the store or Stripe Customer Portal (as applicable).

6.4 Payment processors & RevenueCat

We use third-party payment processors. RevenueCat may be used to validate and reconcile in‑app subscription events with our servers.

6.5 Channel exclusivity (avoid double billing)

To reduce the risk of duplicate subscriptions, entitlements are tied to a payment channel (for example Apple, Google Play, or Stripe). You cannot maintain two active paid channels at once; switching channels typically requires letting the current subscription expire (or cancel at period end) before purchasing on another channel. 6.6 Upgrades & downgrades

Upgrades/downgrades follow store/Stripe rules and our server validation logic. Entitlements are determined by records on our systems after successful verification.

6.7 Refunds

Refund eligibility follows Apple, Google, and Stripe policies and applicable law. Where digital content is delivered instantly, statutory withdrawal rights may be limited.

7. Disclaimers & limitation of liability

To the maximum extent permitted by law, we disclaim indirect, consequential, special, or punitive damages. Our aggregate liability for claims relating to the service is limited to the greater of (a) one hundred U.S. dollars (USD $100) or (b) amounts you paid us in the twelve (12) months before the claim (exclude if prohibited).

8. Suspension & termination

We may modify, suspend, or discontinue features. You may stop using the service. We may terminate for breach or risk.

9. Governing law & disputes

These Terms are governed by the laws of the Hong Kong Special Administrative Region of the People’s Republic of China, excluding conflict-of-law rules. Disputes shall be resolved in the courts of Hong Kong SAR having competent jurisdiction.

10. Miscellaneous

If a provision is invalid, the remainder remains in effect. These Terms constitute the entire agreement regarding the subject matter here.
